1. Agreement and eligibility
These Terms & Conditions (“Terms”) are a binding agreement between you and the company operating the A2B and A2B Rx services (“A2B,” “we,” “us,” or “our”). The “Services” include the A2B Care mobile application, related APIs, communications, delivery-information features, and support.
You must be at least 18 years old and legally able to enter into a contract. If you enter information or use the Services for another person, you represent that you are authorized to do so and will comply with applicable law and that person’s rights.
2. The A2B Care service
A2B Care provides technology that may help users view delivery information, connect with participating pharmacies, communicate with authorized participants, submit refill-review requests, maintain profile and family-recipient information, receive notifications, and interact with Abby.
A2B is not a pharmacy, healthcare provider, medical professional, insurer, emergency service, or medical transportation provider. A2B does not dispense medication, approve prescriptions, determine treatment, or guarantee that any pharmacy, driver, order, refill, or feature will be available.
We may add, remove, test, suspend, or modify features when reasonably necessary, subject to applicable law.
3. Accounts, verification, and security
- Provide accurate, current, and complete information and keep it updated.
- Your mobile phone number is verified through a one-time code. Do not share codes, tokens, or account access with an unauthorized person.
- You are responsible for activity through your account and device. Notify support promptly about unauthorized access, a lost device, or compromised credentials.
- Do not create duplicate, false, automated, or impersonating accounts.
- We may verify account information or request additional information when reasonably necessary for security, delivery support, legal compliance, or misuse prevention.
4. Orders, delivery status, and proof
Order status, route progress, arrival estimates, delivery windows, driver location, address information, and notifications may be delayed, incomplete, or changed by a pharmacy, driver, traffic, connectivity, weather, or operational events. They are informational estimates, not guarantees.
You are responsible for keeping delivery and contact information accurate, being reasonably available for delivery, following lawful delivery instructions, and promptly contacting the pharmacy or support about an incorrect address or material problem.
Authorized delivery records may include photographs, signatures, timestamps, location evidence, failed-delivery records, and returns. Do not ask a driver to falsify, bypass, or misrepresent a scan, signature, photo, location, recipient, or completion event.
A2B does not control package contents, medication quality, labeling, dosage, prescribing, dispensing, substitutions, or pharmacy decisions. Questions about medication or an order’s contents must be directed to the applicable pharmacy or licensed professional.
5. Pharmacy connections
A pharmacy may invite your A2B Care account to connect. You may accept or decline. You may be connected with more than one pharmacy, and each pharmacy may access only its authorized relationship and order information. Disconnecting a pharmacy stops future relationship access as described in the app but does not erase historical orders, delivery evidence, messages, or records that must be retained.
A pharmacy relationship does not mean A2B endorses the pharmacy or assumes responsibility for its professional services, dispensing decisions, products, billing, or separate privacy practices.
6. Refill-review requests
A refill request in A2B Care asks the selected pharmacy to review a prior eligible order. It is not a prescription, approval, renewal, medical order, guarantee of availability, or confirmation that medication will be prepared or delivered. The pharmacy may need to contact you, obtain authorization, verify eligibility, or decline the request.
For urgent medication questions, contact the pharmacy or an appropriate licensed professional directly. Do not rely on the app to meet a deadline or prevent an interruption in medication.
7. Chat, attachments, and user content
You may communicate only with participants made available through an authorized pharmacy relationship or delivery. Keep messages lawful, accurate, respectful, and relevant. Do not send abusive, threatening, discriminatory, fraudulent, unlawful, or unsolicited promotional content.
You retain ownership of content you submit. You grant A2B a limited license to host, process, transmit, display, and retain it as necessary to operate, secure, support, and document the Services. You represent that you have the rights and authorization required to submit the content and that it does not infringe another person’s privacy, intellectual-property, or other rights.
Do not upload malware, unnecessary identification documents, financial credentials, intimate images, or information about another person without authorization. Communications may be retained and reviewed as permitted by law for delivery operations, support, safety, security, and dispute resolution.
8. Abby, AI, and health information
Abby is an AI-powered virtual assistant. Abby is not a person, doctor, pharmacist, healthcare professional, emergency service, or substitute for professional advice, diagnosis, treatment, or medication instructions. AI responses can be incomplete, inaccurate, or inappropriate for your circumstances.
Do not change medication, dosage, treatment, or professional instructions based on Abby. Verify important information with the pharmacy or an appropriate licensed professional. Abby must not be treated as having completed an order, refill, reminder, pharmacy contact, or account action unless the app separately confirms that action.
Your use of Abby is voluntary. Messages may be processed by contracted AI and cloud providers as described in the Privacy Policy. Do not submit another person’s confidential information unless authorized.
9. Emergency and urgent situations
A2B Care, Abby, chat, notifications, and support are not emergency services and are not continuously monitored for emergencies. If you believe there is an emergency or an immediate threat to life or safety, call 911. For poison exposure in the United States, contact Poison Control at 1-800-222-1222. Contact an appropriate licensed professional for urgent medical concerns.
10. Prohibited conduct
You may not:
- use the Services for unlawful, deceptive, abusive, harassing, discriminatory, or fraudulent activity;
- impersonate another person, share unauthorized access, falsify information, or evade an account restriction;
- interfere with a delivery, misuse package or driver information, or fabricate a signature, photograph, status, rating, location, or other record;
- scrape, reverse engineer, disrupt, overload, probe, bypass, or gain unauthorized access to the Services, except where a restriction is prohibited by law;
- introduce malware, automate unauthorized requests, misuse chat, or interfere with another user;
- use pharmacy, driver, account, or delivery information for unrelated marketing, stalking, discrimination, fraud, or other unauthorized purposes; or
- infringe privacy, publicity, intellectual-property, contractual, or other rights.
11. Privacy
Your use of the Services is governed by the A2B Care Privacy Policy. Use account, pharmacy, delivery, and communication information only for its intended purpose and protect verification codes and device access.
12. Third-party services
The Services may rely on or link to pharmacies, delivery organizations, SMS verification, push notifications, address lookup, maps, AI providers, app stores, device platforms, and other third-party services. Their separate terms and privacy policies may apply. A2B is not responsible for independent third-party services, professional decisions, content, availability, security, or conduct except to the extent required by law.
13. Account restriction, closure, and deletion requests
You may stop using the Services and submit an account-deletion request in the app. A2B may restrict, suspend, investigate, or terminate access when reasonably necessary for security, suspected fraud, unlawful activity, material breach, misuse of sensitive information, delivery interference, legal compliance, or risk to users, organizations, drivers, packages, systems, or A2B.
Account closure does not require deletion of order history, delivery proof, communications, refill-review, security, legal, or audit records that A2B or an authorized organization must retain. Sections that by their nature should survive—including privacy, records, intellectual property, disclaimers, liability, disputes, and general terms—will survive.
14. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” A2B disclaims warranties, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted or error-free operation.
A2B does not guarantee any pharmacy service, medication, refill, delivery time, driver availability, route estimate, message delivery, AI response, notification, third-party service, or particular outcome. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.
15. Limitation of liability
To the maximum extent permitted by law, A2B and its affiliates, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of data, goodwill, opportunities, or use; or damages arising from third-party conduct, pharmacy decisions, package contents, delivery delays, communications, AI output, unauthorized account access, or inability to use the Services.
To the maximum extent permitted by law, A2B’s aggregate liability arising out of or relating to the Services or these Terms will not exceed one hundred U.S. dollars (US $100).
These limitations do not limit liability that cannot legally be limited, including liability where prohibited for gross negligence, willful misconduct, or personal injury.
16. Governing law and disputes
These Terms are governed by New York law, without regard to conflict-of-law principles, except where applicable law requires otherwise. Before filing a formal claim, you and A2B agree to make a good-faith effort for at least 30 days to resolve the issue by emailing office@a2brx.com with a description and requested resolution.
Unless applicable law requires another forum, unresolved disputes will be brought in state or federal courts located in Kings County, New York. Nothing prevents emergency or injunctive relief or a legally available small-claims procedure.
17. Apple App Store and Google Play terms
If downloaded from Apple’s App Store, these Terms are between you and A2B, not Apple; Apple is not responsible for the app or its content and has no maintenance or support obligation. Apple is a third-party beneficiary and may enforce applicable terms.
If downloaded from Google Play, Google is not responsible for the app or Services. You must comply with applicable app-store, mobile-carrier, device-platform, and third-party terms.
You represent that you are not in a country subject to a U.S. government embargo and are not listed on a U.S. government prohibited or restricted-party list.
18. General terms
A2B retains all rights in the Services, software, design, trademarks, content, and technology except content owned by users or third parties. We grant a limited, revocable, non-exclusive, non-transferable license to use A2B Care for its intended purpose while these Terms remain in effect.
You may not assign these Terms without written consent. A2B may assign them in connection with financing, merger, reorganization, sale, or transfer of the Services. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remainder continues.
These Terms and the Privacy Policy constitute the applicable agreement for A2B Care. We may update these Terms by posting a revised version and changing the effective date. Additional notice will be provided when required.
